Introduction and effectiveness of the General Conditions
These general conditions of sale (hereinafter, the "General conditions") Have as their object the regulation of the purchase of products, made remotely and made available, via the internet, from the sitehttps://conciliumcosmetics.com (hereinafter, the "Site") In compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the"Consumer Code”).
The seller of the products and owner of the Site is the company GP DERMAL SOLUTION S.R.L. with registered office in 37122 - Verona (VR), Piazza Renato Simoni n. 3, VAT number 04430740235, having an e-mail address email@example.com (hereinafter, "GP DERMAL”).
The consumer who accesses the Site to make purchases (hereinafter, the "Customer") Is required, before sending the order, to carefully read these General Conditions which have been made available to him on the Site and which will be available at any time by the Customer also through the link contained in the confirmation email of each order to allow it to be played and stored.
In the event that the person making purchases on the Site requests an invoice and / or in any case is not a "consumer or user"As defined in art. 3, paragraph 1, lett. a) of the Consumer Code, the withdrawal regulations pursuant to art. 7 and 8 of these General Conditions nor, more generally, the provisions that pursuant to the same Consumer Code apply only to consumers.
Contracts concluded with GP DERMAL through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.
Choose and order the Products
The characteristics and the price of the various products for sale on the Site (hereinafter, the "Product"Or"Products") Are shown on the page relating to each Product.
By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided to him during the purchase procedure and to fully accept these transcribed General and Payment Conditions.
The contract stipulated between GP DERMAL and the Customer must be considered concluded with the acceptance of the order by the selling company. This acceptance is communicated to the Customer through an e-mail confirming the order itself containing a reference to these General Conditions, the order number, the shipping and billing data, the list of the Product or Products ordered with the their essential characteristics and the total price, including delivery costs. The Customer will check the confirmation e-mail and if it identifies errors in the order will have 12 hours of time from receipt of this e-mail to contact Customer Service by e-mail or other suitable means of communicating the detected error to GP DERMAL. After this deadline, if the order has already been processed for shipment, changes will no longer be accepted, without prejudice to the rights of the Customer referred to in Article 7 below.
Once the order has been received, GP DERMAL will check the availability of stocks for the fulfillment of the order. In the event that one or more Products are not available, GP DERMAL will promptly send an e-mail to the Customer who, within the following 48 hours, will have the right to respond to request the shipment of any other available Products or cancel it. In case of no reply within this period, the order will be considered confirmed for the available Products and the same will be sent for shipment. In both cases, the amount relating to the missing Products will be reversed immediately or refunded depending on the payment method chosen.
The information and characteristics relating to the Products sold by GP DERMAL are available on the Site.
The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be fully representative of its characteristics and quality but may differ slightly in color and size. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.
The taxes and duties of the Products purchased and the related shipping costs will be quantified in the checkout section, which can be accessed from the Cart. In this way, the Customer, before definitively confirming the order, can view the total amount for the purchase of the chosen Products.
If the sum of the price of the Products purchased is less than € 55.00, the shipping costs will be quantified separately and made known to the Customer in the manner described above.
In the opposite case in which the Customer purchases Products for a total amount exceeding € 55.00, the shipping costs will not be charged to him.
All prices are expressed in euros.
Methods of payment and billing Payment methods
The Customer may pay the price of the Products and the related delivery costs by credit card, PayPal, bank transfer and any other methods available on the Site.

Once the order is confirmed, the Customer will be redirected to the PayPal site where he can make payment with his account or using a card, even prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relevant conditions.
The Customer must make the transfer within 3 days from the order date for orders relating to products. If payment does not occur within 3 days, the order will be canceled and the goods made available again for purchase by other customers. The Customer who has not made the transfer may be contacted by Customer Service in order to clarify whether the cause of the non-credit is due to the Customer's will not to confirm the purchase or to other causes.

d) Payment on delivery by cash on delivery
Payment is made upon delivery and in the hands of the carrier responsible for shipping the order.
If the purchase is made by a professional, it will be possible to request an invoice by selecting the appropriate box during the first section of the checkout and entering the billing information including tax code and / or VAT number. In this case, the invoice will be sent by e-mail to the address indicated. - Transport and delivery
The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate "Shipping Data" field.
Purchases will be delivered by Express Courier (hereinafter, the "Courier service”), Operational from Monday to Friday, excluding holidays and national holidays. GP DERMAL is not responsible for unforeseeable delays or those not attributable to it.
In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered to the carrier within a period of 7 (seven) working days starting from the day following that in which GP DERMAL confirmed the order to the Customer via specific e-mail.
Once the Products have been shipped, the Customer will receive a confirmation email.
- Active delivery services in Italy:
Shipments to Italy provide for a delivery time of 3/4 working days.
- Delivery services active abroad:
Shipments abroad can be made with different couriers depending on the country of destination in order to ensure the customer the best available rate.

Right of withdrawal
The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty,without prejudice to the cases of exclusion provided for in point 4 below. To exercise this right, the Customer must send GP DERMAL a communication no later than 14 days from the date of receipt of the Products purchased, using the form contained in Annex 1 of this information or, if he intends to exercise the withdrawal before having received the Products, the notice of withdrawal may be sent at any time prior to their receipt.

GP DERMAL will provide, once the communication has been received and verified that it is not a case of exclusion of the right of withdrawal referred to in point 4 below, to open a practice for the management of the return and to communicate to the Customer the instructions on how to return the Products, which will take place by courier indicated by GP DERMAL itself.
The right of withdrawal is governed by the following conditions:
- the law applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the withdrawal only on part of the purchased Product;
- in case of exercise of the right of withdrawal, GP DERMAL will refund the Customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the notice of withdrawal was received, without prejudice to the right to GP DERMAL to suspend the payment of the reimbursement until the actual receipt of the goods;
- the refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method. In case of bank transfer or cash on delivery, the Customer will be responsible for providing the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN);
- the Products must be returned in the same box in which they were received.
In addition to the indicated cases of non-consumer customer and / or requesting the invoice, the right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 296/2005, as amended by the subsequent Legislative Decree 214/2014:
- order of products made to measure or clearly personalized;
- supply of sealed goods that cannot be returned for hygienic reasons or related to health protection and have been opened after delivery.
With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that the sealed goods that have been opened after delivery include all the cosmetic products sold by GP DERMAL, as their organoleptic characteristics, structural, functional and hygienic are subject to alteration as a result of inappropriate storage.
In cases where the right of withdrawal is excluded, GP DERMAL will return the purchased Products to the Customer, charging the shipping costs to the Customer.
Free return in case of exercise of the right of withdrawal
As a most favorable condition for the Customer, GP DERMAL fully bears the shipping costs for the return of the Products in case of exercise of the right of withdrawal.
In order to benefit from this free shipping, the Customer who intends to exercise the right of withdrawal must follow the procedure indicated in the previous article 7 and wait to be contacted by GP DERMAL to agree on the return of the Products to the courier.
Warranty and lack of conformity
In the presence of lack of conformity of Products sold by GP DERMAL, the Customer must immediately contact the seller by email at the address email@example.com, reporting the differences presented by the purchased goods with respect to the sales contract.
The legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code. The warranty covers defects existing at the time of delivery, that is to say the original defects of the product that occur within 24 months from that moment, with the exclusion, therefore, of defects occurring (e.g. due to use , lack of or bad maintenance, etc.).
In case of lack of conformity, the consumer can demand from the seller that the goods be replaced or repaired, at his choice, without additional costs and within a reasonable time. When the repair or replacement is objectively impossible or excessively burdensome, or the replacement or repair previously carried out has caused significant inconvenience to the Customer, he can request the termination of the contract (with simultaneous return of the price paid and the purchased good) or the reduction proportional to the price.
The legal guarantee is not valid if it was the Customer who caused the damage, or if he knew or could have known the defect at the time of purchase, or if the lack of conformity derives from instructions provided by the Customer.
The Customer has the right, at his choice and provided that the type of Product allows it, to restore, without charge, the conformity of the Product by replacement, or to an appropriate reduction in the price or to terminate the contract.
The Customer loses these rights if he does not report the lack of conformity to GP DERMAL within 2 months from the date on which he discovered the defect, provided that it is not a Product which by its nature is perishable or subject to expiry in a shorter term, in which case the defect must be reported within this reduced term.
The complaint must be made by specifying and proving specifically the alleged lack of conformity that led to the activation of the guarantee.
Errors and limitations of liability
The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which GP DERMAL cannot therefore be held responsible, except in the case of willful misconduct or gross negligence.
GP DERMAL reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to change or update information at any time without prior notice, without prejudice to the Customer's rights under these Conditions Generali and the Consumer Code.
Except for willful misconduct or gross negligence, any right of the Customer to compensation for damages or the recognition of compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial. , of an order.

Online resolution of consumer disputes (ADR and ODR)

According to Article 49, paragraph 1, letter V of the Consumer Code, the Customer can make use of the Joint Conciliation procedure. The Procedure can be initiated if the consumer, after submitting a complaint to the selling company, has not received a response within 45 days or has received a response that he does not consider satisfactory.

Online Dispute Resolution (ODR)
Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he or she may submit a complaint via the ODR platform of the European Union which can be reached at the following link http://ec.europa.eu/consumers/odr/. The ODR platform constitutes an access point for users who wish to resolve disputes arising from online sales or service contracts out of court.
Applicable law and competent court
The sales contract between the customer and GP DERMAL is concluded in Italy and governed by Italian law. For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, if the Customer is a consumer pursuant to the Consumer Code, the court of his / her municipality of residence will be exclusively competent. domicile, if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Verona forum.
Contract concluded at a distance
In accordance with the industry practice for the stipulation of on-line contracts, the Customer has had the opportunity to carefully read and archive these Conditions on a durable medium. In particular, the Customer has been expressly made aware of the conditions highlighted by GP DERMAL in the articles: 6. (Transport and delivery), 7. (Right of withdrawal), 9. Therefore, the applicability of the regulations referred to in Articles 1341 and 1342 of the Civil Code is excluded.
By proceeding with the purchase of GP DERMAL Products through the Site and clicking on the respective check box, the Customer declares to have read carefully, understood and accepted these General Conditions.
INFORMATION ON THE RIGHT OF WITHDRAWAL
(pursuant to art. 49, paragraph 4, Legislative Decree 21/2014)
The Customer has the right to withdraw from the contract concluded between him and the seller, without indicating the reasons, within 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods. To this end, you can use the attached withdrawal form, or any other type of explicit written declaration of your intention to withdraw from the order, as long as it is sent to the address indicated above with the forms and within the terms mentioned above.
The right of withdrawal is excluded in the following cases:
• order of products by a non-consumer customer and / or requesting an invoice;
• order of products made to measure or clearly personalized;
• order of products that are likely to deteriorate or expire rapidly;
• order of sealed products that cannot be returned for hygienic reasons or related to health protection or that have been opened after delivery.
With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that among the "Sealed products that have been opened after delivery”All cosmetic products sold by GP DERMAL are included, as their organoleptic, structural, functional and hygienic characteristics are subject to alteration as a result of inappropriate storage.
In the event of exclusion of the right of withdrawal, GP DERMAL will return the purchased products to you, charging you the return shipping costs.
If you withdraw from this contract (except in the cases listed above in which the withdrawal is excluded) you will be reimbursed for all payments you have made in our favor, including any delivery costs (with the exception of additional costs deriving from your possible choice of a type of delivery other than the least expensive type of standard delivery we offer). Refunds will take place without delay and in any case no later than 14 days from the day we are informed of your decision to withdraw from the purchase order, without prejudice to our right to suspend the refund until receipt of the goods. Refunds will be made exclusively in your favor and using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise or if your payment has been made by cash on delivery (in the latter case the refund will be made to by bank transfer to the coordinates indicated by you); in any case, you will not have to incur any costs as a consequence of this reimbursement.
GP DERMAL fully bears the shipping costs for returning the products in case of exercising the right of withdrawal. In order to benefit from this free shipping, you will have to wait to be contacted by GPDERMAL following your notice of withdrawal to agree on the return of the products to the courier indicated by us and you will have to return the products in the same box in which they were received. You are only responsible for the decrease in the value of the goods resulting from handling the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
